Spousal maintenance might be granted if the parties agree, or if the court finds that the spouse wanting spousal maintenance:<\/p>\n<ul>\n<li>Lacks adequate property to furnish for their needs<\/li>\n<li>Lacks adequate earning capability, or has custody of a child in which age or condition is such that the custodian shouldn\u2019t be required to look for employment<\/li>\n<li>Furnished to the other spouse\u2019s education<\/li>\n<li>Had a marriage of long period and is of an age that prevents employment acceptable to be self-supporting<\/li>\n<\/ul>\n<p>The amount and period of spousal maintenance considers the following elements:<\/p>\n<ul>\n<li>The standard of living throughout the marriage<\/li>\n<li>The length of the marriage<\/li>\n<li>The age, employment, earning capability, and emotional and physical state of the spouse wanting maintenance<\/li>\n<li>The ability of the other spouse to meet their needs while paying maintenance<\/li>\n<li>Comparable financial capital and earning capabilities<\/li>\n<li>Benefaction of the spouse wanting spousal maintenance to the other\u2019s earning capability<\/li>\n<li>Degree to which the spouse wanting maintenance has decreased income or career prospects for the benefit of the other<\/li>\n<li>Capability of both to impart to the educational costs of the children<\/li>\n<li>Financial capital, and ability to meet needs, of the party wanting maintenance<\/li>\n<li>Time required to obtain education or training to find suitable employment<\/li>\n<li>Unreasonable or unusual expenditures, ruination, cover-up or deceitful disposition of community or jointly owned property<\/li>\n<li>The cost of health insurance for each party<\/li>\n<li>judgments and compensation from a criminal conviction of one or the other spouse where upon the other spouse or child was the injured party<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Child_Custody_in_Arizona\"><\/span>Child Custody in Arizona<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>If there are any minor children involved, a custody resolution will be required. Customarily, one parent was granted custody, and the other was allowed visitation rights. The judge will then make their decision based on the following:<\/p>\n<ul>\n<li>The previous, present, and subsequent relationship among the parent and child(ren)<\/li>\n<li>The relationship among the child and parents, siblings, and\/or other significant individuals<\/li>\n<li>The physical and mental health of everyone engaged<\/li>\n<li>The child\u2019s settling into home, school, and their community<\/li>\n<li>The desires of child, if of appropriate age and matureness<\/li>\n<li>Which parent is more probable to promote contact with the other<\/li>\n<li>In the event one parent deliberately misled the court to incite a delay, heighten the cost of litigation, or sway the court to give precedence to that parent<\/li>\n<li>The agreement or not having an agreement in regard to joint legal decision making<\/li>\n<li>Any domestic abuse and\/or child abuse<\/li>\n<li>Any intimidation by a parent in acquiring an agreement<\/li>\n<li>In the event a parent has gone through a class on the effect of divorces on families<\/li>\n<li>In the event either parent was convicted of maliciously informing of child abuse or neglect<\/li>\n<li>In the event of a parent\u2019s lack of an agreement is irrational or motivated by a matter unrelated to the child\u2019s best interests<\/li>\n<li>The ability of the parents working together in decision making<\/li>\n<li>Whether or not joint decision making is rationally possible<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Child_Support_in_Arizona\"><\/span>Child Support in Arizona<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The Arizona child support mandates, that can be acquired by the Superior Court clerk, examine the child\u2019s needs and the parents\u2019 competence to meet those needs.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Miscellaneous_Issues\"><\/span>Miscellaneous Issues<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>An ex-spouse\u2019s previous name may be reestablished as part of the Decree of Dissolution of Marriage.
